I disagree with Michelle Malkin, whom I adore and normally find myself nodding in agreement with. Michelle writes:

We are at war, fools. You really want to make this idiot a civil liberties martyr? Stop clucking and get serious.

I am serious and I disagree with her.

I'm not the staunch supporter of the Patriot Act that many who have argued with me say I am. That label is often given to me because I don't find the PA to be the threat people want to make it out to be so it is assumed I agree with it 100%. I don't. But every time someone wails that "they can do X without a warrant or due process" and I reply verbatim the clauses which go something like "investigative officer has certified to the court that the information likely to be obtained by such installation and use is relevant to an ongoing criminal investigation" and "provided that such an investigation of a United States person is not conducted solely on the basis of activities protected by the first amendment to the Constitution of the United States", it is assumed I am part of the Jackboot Clan.

But using the Patriot Act against some idiot who did something bone-jarringly stupid is only going to fuel the fires of the already paranoid. The fact that the guy lied about it should be enough to prosecute and win, why pull out the big guns for such a minor incident? The fact that the man did something dangerous & stupid doesn't automatically elevate his actions to terrorist level.

Let's look at the passages that Michelle says we should read and that would appear to be relevant to Dork-of-the-Year Laser Guy:

 (5) interferes with, disables, or incapacitates any dispatcher, driver, captain, or person while they are employed in dispatching, operating, or maintaining a mass transportation vehicle or ferry, with intent to endanger the safety of any passenger or employee of the mass transportation provider, or with a reckless disregard for the safety of human life;
‘‘(6) commits an act, including the use of a dangerous weapon, with the intent to cause death or serious bodily injury to an employee or passenger of a mass transportation provider or any other person while any of the foregoing are on the property of a mass transportation provider;

Here's where the legal BS goes out the window. Did the man intend to do any of that, or was he just thinking it was cool that his laser could put a dot on something so far away? I'm very guilty of putting my laser pointer dot (red, not green) on buildings and signs (never at a vehicle or movie theater though. I'm not that immature). To be able to do so from miles away would be kind of neat too and I could see where someone who's engine isn't firing on all pistons might think painting the bottom side of an airplane would be a hoot.

So it looks like we've got a garden variety idiot here who lied to save his skin. Punish him, yes. Maybe a few months community service and a hefty fine, but trying to use the Patriot Act as the way to stop stupidity is....well, IMHO stupid. I haven't had much fear of the PA, but if it is going to be whipped out over something this asinine, I might have to start reconsidering my position.

Update:

Not being one known for his good writing, let me summarize my point with a question. What is gained by invoking the Patriot Act that the normal law fails to achieve? If I'm missing something, I'm more than willing to change my tune.

It appears your objection is the Patriot act, itself?

Fine; we can discuss the Patriot act at another time.

How about taking the number of people on the plane, plus the number of the people on the ground for about 8 to 10 miles around, and charge him with that many counts of reckless endangerment? While you're at it, fine the idiot the number of however many million dollars it took to investigate where it came from?

Does this paint a slightly more serious picture for you?
Frankly the guy got off light, by means of the Patriot act.

Just to be clear -

Dufus should be keelhauled.
Patriot Act - No problems with it, really. Just don't like to see it used for this when standard law can take care of it.

He used a tool in a way identical to a terror weapon (in the same way that ordinary box cutters became a terror weapon). In the absence of clear intent, you have to assume that if his actions would result in a terror-like result, he's a terrorist.
The thing is, who can prove what his intent was?
Was David Koresh a terrorist? Timothy McVeigh? Ted Kasinski? Terry Nichols? Richard Reid?
You might get all sorts of different answers if you asked them. So this guy was just messing around, sure. So the next time Osama bin Zarqawi nearly brings down a jetliner with a laser, he just says "oops!" and gets charged with misdemeanor reckless endangerment?

Laws aren't just to punish a criminal, they are also supposed to be somewhat of a deterrent to idiots. They are also, to an extent, the embodiment of the agreement between citizens: "these are the things we don't do, for these reasons". So to me, the Patriot Act in this case says: "Terrorists already have too many advantages of being combatants in civilian disguise, don't make it even easier for 'em by mimicking their techniques."

But I could be talked out of that view, I guess.

I agree that laws are there to punish and to warn. Don't we have enough laws already for what this guy did?

There was once this ditzy leftie chick who posted a message about killing the POTUS. The FBI responded just like they should and after interrogating her, realized she was a 20-something bint still living with her mother and not a true threat.

Look, the guy deserves hell for what he did. Stupid, stupid, stupid. But the Patriot Act is not loved by many and using it under this circumstance (IMHO) will only cause the moonbats to screech louder.

I guess my reaction was the opposite. I heard lots of talking heads on CNN and MSNBC screeching about this poor, misguided boob being persecuted under that horrible old Patriot Act even though he's obviously not a terrorist, and thought, "Ah, this is the tack the Democrats are going to take next to undermine the Bush Administration: no matter who we catch, it will be argued they aren't a terrorist like Osama 'been forgotten' who Bush has completely lost sight of in his misbegotten adventure in Iraq trying to avenge his Pappy!"
Now, I'll admit it gave me pause when a conservative-minded person I like and respect (and give grief to) as much as you has problems with it, but until your post, I took the screeching as proof it was the right thing to do: if it causes wailing and gnashing of teeth in your enemies/opponents, why not keep doing it?

Let me jump in here for just a moment, if I may...

Personally, I think they should throw the book at this guy, using the Patriot Act and anything else they can think of.

Why? Maximum deterrent. People need to be reminded -- periodically -- that, during the War on Terror, looking like a terrorist is a Very Bad Thing to do, whether you mean it or not.

Terrorism strikes at the public trust that is the very fabric of society. Terrorism makes us all a little more afraid, and causes the security forces to crack down on civil liberties a bit more in the name of making us all safe. People pretending to be terrorists, for cheap laughs or because they don't know any better, get exactly the same results... and, in the bargain, make the anti-terrorist work that much harder.

If the moonbats want to scream about this, let them. Let them also think twice next time they want to wave a laser pointer around.

Or are laws to be applied unequally?

Look, let's say this guy managed to kill a bunch of people with his action.(Which I note with a shudder, he stood a damned good chance of doing!) Would he not be under the full weight of the law simply because 'he really didn't mean it, he was just being stoooooopid?'

I'm not saying what he did wasn't so blatently stupid and that he shouldn't get punished, what I'm asking is why does the Patriot Act need to be invoked for this?

There are plenty of other laws I'm sure that can be applied here.
