Florida Carry , Out of sight, out of mind

Florida is only 1 of 6 states that disallows firearms in non-sensitive areas of an airport

The Federal government has determined that the "sterile area" is the "sensitive place" at an airport but Florida has gone much farther and banned even licensed carry inside the entire terminal, on this topic Florida is one of the most restrictive places in the country.

I didn’t know this a while back. I may have even blogged about committing a felony. Pretty sad.

NC does not prohibit it by statute but every airport I have been to has a no guns allowed sign on the entrance roads. Signs such as that would be considered binding under state law and you can be prosecuted for violating them.

So if Guns are banned from even being on Airport Property, how does one check them in when one is transporting them? Going on an Elk Hunt this Fall? Flying to Denver? Taking your .300 Win Mag? Ooops! Here's your Felony Conviction! But I'm following TSA Rules! Too Bad! Someone better let the Governor know that if he wants to keep his job, he'd better get this Straightened Out.

Yeah, what happens when I fly into FL with my legal-as-church firearm in its TSA-approved container and the airline, in compliance with Federal law, hands it over to me?

According to the Gutmacher book (sixth edition - 2009 is what I have on my desk, the latest revision is at home but I don't expect this has been changed), there is a provision for airline passengers carrying a firearm for shipment in baggage as long as it is already unloaded and encased in a locked container (as per).

Quite frankly, I guess I didn't read this part of the book particularly closely and thought, like Robb, that guns were only restricted in the "secure" area of the airport. Luckily, since I don't fly and I haven't had to pick anyone up at the airport in a LONG time, I don't think I have ever run afoul of this law. So in the immortal words of Nixon... "I AM NOT A CRIMINAL" (holding both hands up, each with... well... at least one finger raised to the establishment).

Florida Statutes

790.06 License to carry concealed weapon or firearm.--

(12) No license issued pursuant to this section shall authorize any person to carry a concealed weapon or firearm into any place of nuisance as defined in s. 823.05; any police, sheriff, or highway patrol station; any detention facility, prison, or jail; any courthouse; any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom; any polling place; any meeting of the governing body of a county, public school district, municipality, or special district; any meeting of the Legislature or a committee thereof; any school, college, or professional athletic event not related to firearms; any school administration building; any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose; any elementary or secondary school facility; any area technical center; any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile; inside the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; or any place where the carrying of firearms is prohibited by federal law. Any person who willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Bringing it in, unloaded and already packed for shipping, is an exception.

Every state pro-gun website should link to the actual state statutes IMO. Less guessing that way.

TN as a state may allow firearms into airports, but the Knoxville one prohibits them with lawfully-binding signage. Not entirely sure how that interacts with checking firearms, apart from those not being loaded, and not being "carried" in the TN-legal definition of the word, but out of all the places to prohibit firearms, they actually took the time to label each and every entrance into the airport... gotta give them credit for that.
