Illegal immigrants plan to leave over Ariz. law

While I disagree with the implementation, I totally agree with the intent of this law. I'd love nothing more than to have unlimited immigration to the US, but reality has time and time again shown this to not be a good idea. The current system is busted, agreed, and it needs to be changed so that anyone seeking a better life can come here. Spend a few years here, learn the language, show you are willing to meld into our society and keep your nose clean and I see no reason to not allow you in.

But walk over here uninvited, suck up valuable resources like schools and hospitals, and bring with you massive amounts of crime? Sorry if I don't feel bad if you're kicked out.

It's not racist. I don't care if it's an African, Asian, Mexican or a member of the Swedish Bikini Team, I don't want you here illegally.

And the fact that this phrase can even be uttered without the slightest hint of irony

which also makes it a crime to be in the U.S. illegally

Saddens me.

Aside from the ludicriousness of "making illegal immigration more illegal", there's a rather blatant but usually overlooked racism involved.

For every person south of the border we let in, without the years of wait and expensive INS lawyers and whatnot, that's a person we didn't let in from Jamaica. Or Poland. Or ...

There's a finite amount that we can possibly let in at any time - unless you're going to throw the "borders" open wide - and what's happening on the border in AZ and Texas ought to demonstrate the realistic problems there - and every time we allow "illegals" to stay - or worst, amnesty them for their crimes - it keeps out just as, or more deserving people who in some cases are dying to get here. Literally.

You shouldn't even dislike the implementation.

It only requires police to ask, assuming they have reasonable suspicion of illegality, IF THEY HAVE ALREADY DETAINED THE PERSON for another reason. (ie. traffic stop, suspicion of another crime, etc.)

If you were pulled over by police in FL you would already do everything necessary to prove legal residency by handing over your license, reg., proof of ins., etc.

Where's the rub?

I admit I see a bit too much potential for abuse, and certainly mistakes: that can be addressed if-or-as it arises. But the hollering classes are assuming/claiming that abuse is the purpose of this law. Codswallop.

As to its being unCOnstitutional, that must also apply to the US Code, which requires non-citizens to have ID and verifiable permission (eg a visa) available on demand.

Hell with petitioning our resident states to do similar things (because all states are having problems with illegal immigration, just to varying degrees) - we should be flat-out demanding that our bleeding federal government do its gorramed job, as is proscribed in the United States Code.

Unfortunately, that stands even less of a chance of happening than Arizona's new law does standing over the coming years.

Illegal immigration is just that - illegal, and until we buck up and start doing something serious about it, the situation is just going to continue deteriorating.

They've tweaked the bill to change the requirements for checking ID. Instead of "lawful contact" it's now arrest/detention.

I'm ok with that. I think there's better ways to close to the border and fight illegal immigration, but at least this bill isn't a blank check for government abuse now.

Y'know, that's the perfect way to put it. If it's a crime it's a crime, but resorting to illegal means ("papers?") to punish that crime ain't acceptable.

Everyone keeps parroting the "Papers Please" line, and it really doesn't come into play at all from what I have read.

If the police don't have "reasonable suspicion" to stop you, then they can't require you to identify yourself.

Try this example. Police stop a minivan for a slam dunk equipment violation (say one headlight, something that can't be argued). Once the minivan is stopped, the driver can't provide a driver's license (this is an arrestable offense). None of the occupants can speak english and none of them have any documentation whatsoever.

Prior to this law, the only person who would be arrested would be the driver, for the traffic offense. They might call the Border Patrol who would say, "eh, they are just misdemeanors, we aren't interested", and nothing would come of it. Now under AZ law, all of these people can be charged locally...

Now, if a police officer sees what appears to be a mexican family shopping at Wal-Mart, speaking only Spanish to each other, he has no reason to stop them.

I know these are line drive examples, but I wanted to make the point as clearly as I could. The police just can't institute checkpoints or walk up to people and demand papers...

And if you are not a natural born citizen, Federal law says you have to carry the papers granting you permission to be in the country, and present them on demand.

We can sit around and complain that this law or that law is not the best solution, or not a perfect solution, but that is a fallacy - whatever we do will be done by imperfect human beings.

We need to start trying things, to find a "good enough" solution. There is a lot of hand-wringing going on, and we need to recognize that for what it is - another delaying tactic.

Say you are born in Florida and have a Florida driver's license. According to the law, that is not proof of citizenship. You need to have an ARIZONA driver's license. Or an American passport or something from the state or national government that says you are a citizen. (I don't know if they are going to accept birth certificates or not. They don't seem to want to accept Obama's.)

It's a lousy law. It needs to be rewritten or repealed.

Whenever it gets released, we might. But when you spend ~$10M USD in legal fees protecting it, well, it does tend to raise some questions.

I take it you don't live anywhere near the border, and haven't yet had your identity stolen by an illegal "immigrant".

WEll, all that needs to happen is the Feds do their jobs and follow their law and enforce it and there's no need for it.
