Based on his history of drug abuse...probably negligent.

If it wasn't outright suicide.

I can see an accidental drug overdose. Someone who does not have someone to care for them. Does not have clear mental faculties for whatever reason (elderly, illness or the drug they're taking causes confusion), getting confused about how much they've taken and taking more than they should.

That I'd consider an accident.

If they were intentionally taking more than prescribed, or taking drugs for recreational purposes, I'd be more inclined to call it negligent.

To be honest, though, I'm not that concerned about negligence that results in a darwin-award situation.

If you stupid yourself to death without endangering others, it's none of my concern, no matter what you call it.

The cases of negligence that I'm more concerned about are those that harm, or have have the potential to harm, others.
