The biggest problem I see is that if, by some miracle, in 2010 the Democrats were to lose and lose big?

It would mean that the Republicans won, and won big.

The Stupid Party has been famous for getting the mood exactly wrong - and being no better whatsoever than the Evil party, save in the parts of the Bill of Rights that they hack away at...

What's the solution? Well, it would be right pleasant if we had a viable (read: non-bugnuts fucking crazy) third party...

I hate to say it, but people are reading too much into this. It's fine to say "come and take it," but regardless of whether the Congressman would or wouldn't, as a practical matter he's not authorized to do so. He's a legislator; it would be someone under executive control who, you know, executes the collection.
